Professional Ethics Assignment 2


1.      What is the relevance does the concept of law in general have in computing and to study of computer ethics?

The concept of law is important in the study of ethics of which it is relevance to the ethics of computer that we should know. For a better, it helps to know the regulation and limitation of individuals using computer. It can have a systematic arrangement by following and knowing the ethics itself.

2.      List down two governing computer use and explain what types of non-jural law seem to underpin these laws?

·        Do not create something to destruct other for your own sake.
Doing destruction like viruses and hacking are usually can cause to a harmful effect especially in all users intended to be responsible on it because doing these it crossed for non-jural laws on which you undergo the rights of one’s life.

·        Respect private property and opinion of others.
Respect should be a policy, all of us should respect the private property and mostly the opinions of other in order to build a good relationship into others but if you don’t do these you probably show the non respect and it done illegally.

3.      Melinda brought licensed computer software from Cyberzone. Because of the high price she paid for the purchase of the software, Melinda thought of reproducing copies of it to be sold to friends and acquaintances. Melinda knew she would be violating the law. Nevertheless, she executed her plan and sold pirated software. To what extent does each of the four type of law apply in this case?

·        Natural Law
Because Melinda used the private property of Cyberzone on which she committed the laws on the code of ACM that we should  Honor property rights including copyrights and patent that imposing the company rights violation.

·        Moral Law
Melinda also violated the moral laws on which she act the immorality that on the first place she knew that she violated the laws but she still continue doing it for her sake.

4.       Use the  framework for ethical decision making to analyze the given situation and answer the questions that follow.

Situation 1:  You are in charge of awarding all personal computer service related contracts for your employer. In the recent e-mail to the current holder of the service contract for your company, you casually exchange ideas about home landscaping, you favorite pastime. In your e-mail you  stated that you wished you had a few Bradford pear trees in your yard. Upon returning from a vacation, you discover three mature trees in your yard. There is a brief thank you note in your mailbox signed by the local sales representative of your company’s current personal service contractor. You really want the trees, but you certainly didn’t mean for the contractor to buy them for you. You suspect that the contractor interpreted your e-mail comment as a hint that you wanted him to provide you with some trees. You also worry that the contractor still has a copy of your e-mail. If the contractor sent your boss a copy of your e-mail, it might look as you were trying to get a bribe from the contractor. Can trees be considered as a bribe? What would you do?

Ethical Issue
The issue is about whether to accept the bribe that the contractor sent or not.

Facts
In the recent e-mail to the current holder of the service contract of the company, I casually exchange ideas about my favorite pastime landscaping. Upon returning from a vacation, there are trees in my yard and I thought that this trees was sent by local representatives of my company’s current personal service contractor. The contractor misinterpret that my mail comment as a hint that I wanted trees.

Alternative Actions
Utilitarian Approach
 It is better to accept the trees because nobody knows what the contractor wants when he gave the trees in the yard. Just think positive to avoid some sort of problems.

Right Approach
 It is not fair to accept something illegally. Bribing someone can take you in the jail. It is better to not accept the trees for the safety thing.

Justice Approach
 Everyone should treated equally. If it is not a bribe, better to accept it. Otherwise, unfair for others just easy to get something.

Common Good Approach
Just work for the service. As a member of a company, one should think for the equality of others not for being selfish. If the trees that sent to you knew by others, what others will thought about you?

Virtue Approach
By accepting the bribe, the contractor might think that I’m can easily be bribe by something. And others will think that for the sake of wanting my needs, I can accept anything even though it is bribe.

Making Decision
All of the approaches are applicable, but the suitable for me is Right Approach. In decision making, a person must analyze the problem, gather some data and information about the problem, make a hypothesis and perform it. Everyone have their own opinion in this situation.

Reflection of the Outcome
Making a wrong output towards others can cause certain damage. Before making a decision, analyze and think of many possibilities that will happen if you do it.

Situation 2: You are the manager of the customer service desk of a small software manufacturer. The newest addition to your ten – person team is Kelly, a recent college student. She is a little bit overwhelmed by the volume of calls, but is learning fast and doing her best to keep up. Today, as you performed your monthly review of your employee’s e-mail, you are surprised to see that Kelly is receiving a number of e-mails from employment agencies. One of the messages says, “Kelly, I’m so sorry you don’t like your new job. We have lots of job opportunities that I think would better match your interest. Please call me and let’s talk further.” You’re shocked and alarmed. You had no idea she was so unhappy, and your team desperately needs her help to handle the onslaught of calls generated by the newest release of software. If you’re going to lose her, you’ll need tom find a replacement quickly. You know that Kelly did not intend for you to see this personal e-mail, but you can’t ignore what you saw. Should you confront Kelly and demand to know her intentions? Should you avoid any confrontation and simply begin asking her replacement what would you do?

Ethical Issue
Regarding to this situation the ethical issue happened to damaging to someone’s life/personal property but it’s accidentally done not intended at all.

Facts
The manager accidentally read the personal e-mail of Kelly because of analyzing the  monthly review of each team member which is the fact but the manager don’t know what to do, should be an alarmed or what to them. And for that situation you don’t have rights to accused her rather you should confront her first for clarification. We learn about this situation that we must talk first to the person who is involved so that your speculation can clear and to know what is the truth behind.

Alternative Action
Utilitarian Approach
The most good to do is the manager should confront Kelly on that situation happened for clarification and the least harm to do is to ignore on what you’ve seen.

Right Approach
On the other hand for Kelly, once you are worked for the company you should be committed on it and no other company involved. And at the first place you applied to that company, you must worked and be part of it.

Justice Approach
For Kelly’s work, she is responsible on it she did her job accurately even though she is unhappy and dislike the position she have. No complained at all because she is a newly team member of the company.

Common Good Approach
Kelly is the one who made this kind of approach, although she’s not happy on her job she worked for the company and doing her part responsibly.

Virtue Approach
In this situation , the manager did was she know first what to do for the good of company and for the goods of Kelly’s life. She take the consequence of what she done, should be a confrontation, ignoring or finding a new one.

               Making a Decision
For this situation, the best approach o do is the utilitarian approach on which we should know first the good and wrong action should do. Any decision in hurry are not good to do , we should know first what is the problem and how to solve it in a nice way of confrontation. And knowing the consequences is the best thing to do.

               Reflection of the Outcome
For this specific situation, decision in a hurry can cause damage of relationship to each individuals mostly on the company and taking the consequences and confronting is the best thing to do. With this decision it can implement the greatest care and attention of any one involves in this problem. Confronting Kelly in a nice way can gave clarification to anyone. Everyone should learn on it.
